Project Policies, Guidelines, Terms & Conditions

Learn how Nature Works By Design operates. Serving Spring Branch, Texas with trusted landscape design and masonry services.

Our goal is to create a smooth, transparent, and high-quality experience for every client. The following policies are designed to set clear expectations, protect both parties, and ensure your project is completed efficiently and professionally.

 

1. Project Scheduling & Contract Acceptance

Contract Clause –
NatureWorks By Design, LLC (“Contractor”) appreciates the opportunity to serve you. Projects are scheduled in the order in which proposals are approved (signed) and initial payments are received.

Due to high demand and the custom nature of our work, scheduling availability may vary. Estimated start dates are subject to change based on weather conditions, material availability, and the progression of previously scheduled projects.

 

2. Custom Project & Scheduling Expectations

Custom Project / Scheduling Clause –
Client acknowledges that this is a fully custom, nature-based project and not a pre-fabricated, blueprint-style installation.

Due to the artistic and organic nature of the work—including but not limited to:

  • Adaptation to natural terrain

  • Custom stonework and masonry

  • Plant placement and environmental considerations

  • Evolving design elements in real-time

Some aspects of the project require flexibility and on-site decision-making.

If the Client wishes the project to be completed in a timely and high-quality manner, they must allow the Contractor to perform work without undue pressure related to rigid deadlines such as:

  • Parties

  • Holidays

  • Events

  • Personal timelines

The Contractor shall not be held responsible for delays resulting from:

  • Weather conditions

  • Material shortages or delivery delays

  • Labor availability

  • Equipment or machinery issues

  • Unforeseen site conditions

  • Adjustments required during installation

The Client’s cooperation, flexibility, and trust in the process are essential to achieving the intended outcome.

 

3. Material & Logistics Delays

The Client acknowledges and accepts that delays will occur throughout the course of the project due to real-world logistical factors, including but not limited to:

  • Supplier and quarry delays

  • Transportation and traffic issues

  • Equipment breakdowns or maintenance

  • Weather interruptions

  • Labor constraints

  • Backordered or specialty materials

These factors are outside the Contractor’s control and may impact timelines. The Contractor will communicate updates as they arise and adjust scheduling accordingly.

Note: Our team may not be on site every day of the week, though we will provide you the anticipated completion date and project scope punch list that we will follow as a team to ensure proper and timely installation. Our team will communicate with you with arrival dates of our crew, materials, port-o-pottys or other deliveries so you can expect them on site.

 

4. Subgrade & Site Conditions

Subgrade Conditions –
Landscaping and construction projects inherently involve unknown subsurface conditions.

Unforeseen conditions may include:

  • Buried debris or construction remnants

  • Rock, caliche, or unstable soils

  • Hidden utilities or unmarked lines

  • Drainage complications

If such conditions are encountered:

  • Work in the affected area will pause

  • The Contractor will notify the Client

  • Options and associated costs will be reviewed before proceeding

Utility locates will be requested where applicable.


Gas line identification at the residence is the responsibility of the Homeowner.

 

5. Warranty

Warranty –
NatureWorks By Design provides a one (1) year warranty on:

  • Workmanship

  • Installed plant materials

Conditions for Plant Warranty:

  • Irrigation must be installed by a Licensed Irrigator or

  • Existing irrigation systems must be tested and verified as fully functional

  • A proper watering schedule must be maintained

Warranty Exclusions Include:

  • Acts of God (freeze, drought, flood, storm damage)

  • Normal wear and tear

  • Neglect or improper maintenance

  • Misuse or accidental damage

  • Animal or deer damage

Warranty service does not extend or reset the original warranty period unless agreed to in writing.

 

6. Payments & Financial Responsibility

All payments are due as outlined in the signed proposal or contract.

  • Deposits are non-refundable but can be applied as a credit for future work if approved by NatureWorks By Design, LLC

  • Materials ordered are typically non-returnable

  • Additional work or changes may require written approval and added cost

Failure to make timely payments may result in:

  • Work stoppage

  • Removal from schedule

  • Additional administrative or remobilization fees

 

7. Project Communication

All project communication will take place via email, phone, and on-site visits. For accuracy and proper documentation, phone conversations and site meetings may be followed by an email recap from our team. All communication must remain constructive, concise, and respectful, and Clients agree to allow reasonable time for responses. Duplicate or repeated emails sent before a response is provided may result in delayed communication, as it disrupts workflow and project progress.

To maintain efficiency and progress on-site:

  • Communication should remain concise and relevant to active phases of work

  • Extensive revisions, repeated breakdown requests, or excessive communication may impact project timelines

The Contractor reserves the right to:

  • Consolidate communication into scheduled updates

  • Address non-critical items at designated checkpoints

The goal is to keep focus on execution and completion, not unnecessary delays.

 

8. Termination Policy

Termination –
This Contract may be terminated by either party at any time with written explanation.

If terminated:

  • Client shall pay for all work completed to date

  • All materials ordered remain non-refundable and non-returnable

  • Any applicable restocking, cancellation, or administrative fees will apply

  • All deposits are non-refundable but can be applied as a credit for future work if approved by NatureWorks By Design, LLC

The Contractor reserves the right to terminate immediately in the event of:

  • Non-payment

  • Interference with work

  • Unsafe or hostile working conditions

  • Unsafe or threatening client behavior

In such cases, any outstanding balance becomes immediately due.

Payment Disputes & Chargebacks –

Client agrees that any attempt to reverse payment, initiate a credit card chargeback, or dispute a valid and authorized transaction without first providing written notice and an opportunity for resolution constitutes a breach of this Agreement. In such cases, Client shall remain fully liable for the original contract amount, any work completed, materials ordered, and any additional costs incurred by Contractor as a result of the dispute, including but not limited to administrative fees, legal fees, collection costs, and damages to the fullest extent permitted by law.

Online Reviews & Defamation Policy –
NatureWorks By Design, LLC values honest and accurate feedback from our clients. Clients agree that any public review or online statement regarding the Company must reflect a truthful and fair account of their experience.

The Client acknowledges that knowingly posting false, misleading, exaggerated, or defamatory statements—including those made out of frustration, personal disputes, or as leverage in a disagreement—may result in harm to the Company’s reputation and business operations.

Any threats to publish negative or damaging content for the purpose of coercion, retaliation, or undue influence will be considered unacceptable and a breach of the contract Agreement.

In the event that false or defamatory statements are published, the Contractor reserves the right to pursue all available legal remedies to protect its reputation, including but not limited to claims for defamation, damages, and recovery of legal fees to the fullest extent permitted by law.

 

9. Final Acknowledgment

By proceeding with the project, the Client acknowledges:

  • The custom, evolving nature of landscape construction

  • The reality of scheduling and material delays

  • The importance of trust in the Contractor’s process

  • That quality work requires time, flexibility, and professional discretion

Changes to this Document - 
NatureWorks By Design, LLC reserves the right to change this Privacy Policy from time to time. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your account, by placing a prominent notice on our website, and/or by updating any privacy information. Your continued use of the website and/or Services available after such modifications will constitute your: (a) acknowledgment of the modified Privacy Policy; and (b) agreement to abide and be bound by that Policy.
